Terms of Service

By visiting the Two Trees Writers Collaborative website; making an order or inquiry with us; registering for a workshop or session; subscribing to our newsletter; contacting a Two Trees Mentor for one-on-one coaching or manuscript development; or engaging in any of our Offerings and with members of our community; you agree to be bound by the following Terms of Service. These Terms apply to all users of our services, including without limitation browsers, vendors, customers, merchants, and/or contributors of content. 

We may update this policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons. Changes will be posted here. Any new Offerings or Mentors added to the Collaborative shall also be subject to the Terms of Service. Your continued use of, or access to, the website following any updates constitutes acceptance of those changes.  

By agreeing to these Terms of Service you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

GENERAL CONDITIONS 

  • We reserve the right to refuse service to anyone for any reason at any time. 
  • You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us. 
  • You must not transmit any worms or viruses or any code of a destructive nature. 
  • You agree to follow all the rules and requirements set out by the venues where we hold our physical workshops and retreats, and agree to pay for any damages incurred by you against their property and any penalties for your actions or behaviors as set out in their own terms of agreement.
  • The Two Trees Writers Collaborative  prohibits discrimination and harassment based on sex, race, religion, color, national origin, ancestry, age, sex, sexual orientation, gender identity and expression, disability or any other category protected by law.
  • A breach or violation of any of the Terms will result in an immediate termination of your Services.

OUR OFFERINGS

The Two Trees Writers Collaborative brings together like-minded writers interested in mentoring a writing community in intuitive ways. It functions as a virtual gathering place and support system for both writers and Mentors. Through the site, we offer access to group workshops, and individually-led small group intensives, coaching, mentoring and specialty sessions.

Each Mentor is an independent entity, responsible for developing their materials. All intellectual property and academic freedom belongs to the Mentor. In all cases of individually-led Offerings, each Mentor structures their own services, programming, schedule and fees.

Certain Offerings may be available exclusively through the website and offered virtually via Zoom or a similar platform.  We have made every effort to make our Offerings as accessible and high quality as possible. These online workshops and sessions will be available via a password-protected link. We do not warrant that the quality of any workshops, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. We are not responsible for the quality of your own internet connection.

Workshops and Offerings may be recorded at the discretion of the Mentor, and with your permission (if one-on-one) or after an announcement to that effect (if a group). Sessions may be shared and viewed by other paid participants for a specified period following the live presentation. The recordings will not be available to public view.  You agree that you will not share or transmit any of the purchased sessions to any other person.

If a workshop doesn’t reach minimum enrollment or we have a scheduling conflict, we may reschedule or cancel up to the day it is set to begin. If we reschedule or cancel, you can request a full refund, or we can transfer your tuition to a new class with the same Mentor. If the workshop is rescheduled, you are welcome to remain enrolled if the new dates work for you.

We reserve the right, but are not obligated, to limit our Offerings to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at our sole discretion. We reserve the right to discontinue any Service at any time. Any offering made on this site is void where prohibited.

You understand that the Two Trees Writers Collaborative is not liable for any direct or indirect, incidental, consequential, or punitive damages arising out of our workshops, individual sessions, or Offerings.

INTELLECTUAL PROPERTY

Unless otherwise indicated, our site, Offerings, and materials are our proprietary property, owned or controlled by us or licensed to us as an entity, or specifically owned and created by the individual Mentor, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, foreign jurisdictions, and international conventions. Our content is provided “as is” for your information and personal use. It may not be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission. This includes any recordings, correspondence or communication connected to our coaching or one-on-one Offerings.

Similarly, your submissions and contributions in workshops and other Offerings are your intellectual property, protected by the same copyright and trademark protection. The Two Trees Writers’ Collaborative and its Mentors will make every effort to protect your creations, including by requiring all participants in group workshops to agree respect and honor each other’s work and the integrity of our sessions together and  and not reproduce, modify, or develop derivative works or publicly display any of the content of the workshops, mentoring guidance, or students’/third party works publically, in teaching, or in social settings.

YOUR OBLIGATIONS

By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms of Use; (4) you are not a minor in the jurisdiction in which you reside unless you have a parent or legal guardian’s written permission; (5) you will not access the Site through automated or non-human means, whether through a bot, script, or otherwise; (6) you will not use the Site for any illegal or unauthorized purpose; and (7) your use of the Site will not violate any applicable law or regulation.

Your Account

You agree to provide current, complete and accurate purchase and account information for all purchases made from us. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of our offerings (or any portion thereof).

You may be required to register with the Site, or for specific courses and sessions. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

Your Contributions

As part of our Offerings, you may be invited to chat, contribute to, or participate in blogs, message boards, online forums, classrooms, and other functionality, and you may be provided with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Site, which may be viewable by other users of the Site, workshop colleagues, Mentors and administrators.  These contributions must be lawful and must follow our Anti-Bullying Policy, our Intellectual Property Policy, any workshop rules or agreements that are distributed with registration or course materials, and any and all other Terms of Service.

Physical Spaces and Property

When convening in person, and in physical spaces or via the use of tangible properties, you agree to be respectful of other people’s property. You agree to follow all the rules and requirements set out by the venues where we hold our workshops and retreats, including appropriate behavior or dress (if applicable), trespass, correct use of equipment and furniture, closing hours, etc. You agree to pay for any damages caused individually by you against their property and accept any penalties for your actions or behaviors as set out in their own terms of agreement, or as per local law and regulation.

User Comments, Feedback And Other Submissions

You agree that your comments and actions will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You will not post, comment or otherwise use Two Trees to distribute unauthorized solicitations, spam, mass mailings and/or advertising. You are solely responsible for any comments you make and their accuracy.

We take no responsibility and assume no liability for any contributions or actions by you or any third-party. Any violation of these Terms of Service by you may result in immediate expulsion from workshops, termination of contract, or removal from the community and website without refund.

HARRASSMENT AND ANTI-BULLYING

Two Trees believes in creating a safe place of inclusion, diversity, equity and respect for all our participants, student and Mentor alike. Your participation in any offering is governed by all our policies and Terms of Service, including our policy against harassment and bullying. You thereby represent and warrant that your contributions to the Two Trees community and website, your engagement with Mentors, and your participation in workshops and courses and in groups, will be respectful, non-harrassing, not discriminatory and supportive to others.  You agree that your contributions and behavior:

  • do not violate, or link to material that violates, any applicable law, regulation, or rule, including those intended to protect the health or well-being of minors; to protect against abusive behavior; and to protect civil rights and equity;
  • are not harassing, libelous, slanderous, or otherwise objectionable; do not include any offensive comments that are connected to ethnicity, national origin, gender, sexual preference, or physical or mental difference or ability.
  • do not ridicule, mock, disparage, intimidate, or abuse anyone, or advocate for violence, or incite, encourage, or threaten physical harm against another;
  • do not violate the privacy or publicity rights of any third party.

Any act or behavior that violates this policy and may result in, among other things, immediate termination or suspension of your participation in our offerings without refund. We have the right to monitor, edit or remove comments on our website that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, or otherwise objectionable or violates any party’s intellectual property or these Terms.

PRIVACY

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from twotreeswriters.com.

Personal Information

When you visit Two Trees, we automatically collect certain anonymous tracking information, including about your web browser, IP address, time zone, and how you interact with our site. We use this information to help us screen for potential risk and fraud, and more generally to improve and optimize our Site.

When you make a purchase or register for a workshop, session or retreat, we collect the personally identifiable information you provide, including your name, billing address, shipping address, payment information, email address, and phone number.  We use this Information to fulfill any orders placed (including processing your payment information and providing you with invoices and/or order confirmations); to generate registration and login information as needed to enable you to participate in the offering; and to  communicate with you about your order; and to screen for potential risk or fraud.

If you subscribe to our mailing list, we will send you periodic updates and information about news, workshops and services offered by Two Trees Mentors.  You may opt out at any time by using the “Unsubscribe” button on a notification received or by writing to [email protected].

Sharing Your Information

We share your Personal Information with third parties only to the extent necessary to help us fulfill your requests, such as to communicate with our store and email partners.  We also use Google Analytics to help us understand how our customers use the Site. You can also opt-out of Google Analytics.

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

What We Don’t Do

We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. We do not use your information to send you advertisements or marketing, unless you have subscribed to request this.  You can unsubscribe at any time.

Data Retention

When you place an order through the Site, we will maintain your order information for our records unless and until you ask us to delete this information.

Online Course Delivery

Our workshops and sessions are currently being delivered online in password-protected classrooms via Zoom (or similar teleconferencing platform). Your privacy is protected there to the extent of the platform’s security. If and when sessions are recorded, you will be notified and have the opportunity to stay off the screen. Recordings will be provided only to paying participants, streaming for a limited amount of time and will also be password protected.

We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. We reserve the right at any time to modify or discontinue a service (or any part or content thereof) without notice at any time, and are not liable for any modification, price change, suspension or discontinuance of our offerings.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

We reserve the right to correct any typographical errors, inaccuracies or omissions on our site or in our offerings, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you. In no case shall The Two Trees Writers Collaborative, our Mentors, or affiliates of any kind be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless The Two Trees Writers Collaborative, our Mentors, and any and all affliates, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

We will maintain certain data that you transmit to the Site for the purpose of managing the performance of the Site, as well as data relating to your use of the Site. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Site. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

These Terms of Service and any policies or operating rules posted by us on the Site or in respect to the Site constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. These Terms operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Terms of Service is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Terms of Service or use of the Site. You agree that these Terms will not be construed against us by virtue of having drafted them. You hereby waive any and all defenses you may have based on the electronic form of these Terms and the lack of signing by the parties hereto to execute these Terms.

REFUNDS

All sales are final. Sessions from group workshops may be viewable via recording if you alert us in advance that you cannot attend and request this. If you are seeking a refund for a group workshop or Offering due to extenuating circumstances, please contact us using our contact form on our website.

Refunds for one-on-one sessions may or may not be available, according to the policies of each Mentor, and if available, are subject to time restrictions and cancellation fees.  Please inquire before your mentoring begins.  In no case will refunds be available for work done, or after the initial scheduled session date has passed.
